A contribuição dos ofícios da cidadania na implementação de políticas públicas de inclusão dos transgênicos no Estado da Bahia

Abstract

The theme of public policies aimed at gender diversity is an emerging issue, and its full realization requires the engagement and joint effort of the whole of society. In this scenario, the present work aims to answer the following question: Can the Citizenship Offices (Civil Registry Offices) contribute to the implementation of public policies for the inclusion of transgenders in the state of Bahia? To answer it, it proposes the following assertion as a hypothesis: the Civil Registry Offices of Natural Persons can positively contribute to the implementation of public policies for the inclusion of transgenders in Bahia, especially due to the capillarity of the service provided. Based on the general objective of investigating the limits and potentialities of the Citizenship Offices in the provision of public services, especially regarding the issuance of documents for the transgender population, this applied research adopts the hypothetical-deductive method of approach, through the which goes through the specific objectives in order to test the formulated hypothesis. In order to fulfill the proposed objectives, the work uses bibliographical and documentary research techniques, forming a theoretical framework regarding topics such as the name of the natural person, gender issues, public policies, notary and registration services, citizenship offices and agreements with the government. In addition, it collects data through a questionnaire with closed and multiple-choice questions, in order to understand the reasons for the low adherence to the agreement with the Federal Revenue Service in the state of Bahia. The choice of these topics is due to the fact that the procedure for changing the first name and gender is the assumption from which all other considerations that seek to answer the central question of this work depart. It is regulated by Provision n. 73/18 of the National Council of Justice and is processed in the Civil Registry Offices. The research deepens the theme of the Office of Civil Registry of Natural Persons and the new guise conferred by Law n. 13,484/17 to this registration attribution, which designates it as “Citizenship Offices” and allows for agreements with the public authorities to provide other remunerated services. The text also deals with existing agreements and the advantages arising from the formulation of these adjustments between the Citizenship Offices and the public authorities, notably due to the efficiency and capillarity of the Extrajudicial Services. The investigation points out that agreements for issuing personal documents would bring advantages to transgender people, as they could, when requesting a change of first name and gender, request the alteration of their personal documents in the Citizenship Office itself, which would save them from exposing your privacy in several places to adjust your personal documents. Finally, the work concludes that the formulated hypothesis is confirmed, in the sense that the Citizenship Offices (Civil Registry Offices) can contribute to the implementation of public policies for the inclusion of transgenders in the state of Bahia, but emphasizes that this fact depends on the joint action of public authorities and Civil Registry Officers
